Sign Up - T&C

1. The “Signup Up Offer” is being brought to you by Reliance Communications International Inc (RCII) and is available to the customers of Reliance Global Call service (the "Service") who reside in United States of America. The details of the Offer and eligibility criteria are more particularly described hereinafter.
2. The Offer shall be valid from the date of launch of the Offer viz. till the 31st March, 2016 12:00 hrs GMT  (Both days are inclusive) (the “Offer Period”).
3.  The term ‘Signup offer’ as used in these terms and conditions, is only to signify the purpose and availments associated to the Prepaid Customers.
4. The Offer is available to the Prepaid Customers (as defined hereinafter). The Prepaid Customers means (i). the prepaid customers who register for the Service during the Offer period ( the “New Prepaid Customers”), and (ii). the prepaid customers for the Service existing as on  Nov 6th , 2012 (12:00 hrs GMT) (the “Existing Prepaid Customers”). The New Prepaid Customers and the Existing Prepaid Customers are collectively referred to as the Prepaid Customers.
5. The Offer will be available for Prepaid Customers of both the Usage Plan i.e. Simply Reliance Plan and General Plan.
6. The New Prepaid Customers upon successful registration for the Service with the denominations mentioned in the table below, during the Offer period are entitled to such Additional Talk time in respect of each denomination. The Equivalent Value of Additional Talktime (in USD) as specified in the table below will be credited to such New Prepaid Customers account within 48 hours of the successful registration for the Service:

7. The Equivalent Value of Additional Talktime (in USD) (the “Offer Benefit”) for New Prepaid Customers is calculated based on the Simply Reliance Plan rate for calling to India from United States of America using Toll Access i.e. 2.00 ¢ per minute and for the successful registrations done during the Offer Period by the Prepaid Customers is calculated based on their Usage Plan i.e. (i) for Prepaid Customers having Simply Reliance Plan, rates for calling to India from United States of America using Toll Access i.e. 2.00 ¢ per minute is considered.
8. The Prepaid Customers shall be bound by the terms and conditions of the Reliance Global Call Customer Service Agreement (CSA) as amended from time to time, which the Prepaid Customers will agree or has agreed to, at the time of registering for the Service.
9. The completion of the call depends upon various things including but not limited to Network Availability, Third Party Network, Network of the Local Service Provider from where the call is initiated, Network of the Service Provider where the call is terminated, Network Availability at the place of calling party and/or Network availability at the place of call receiving party, and so on. Under no circumstances shall RCII be held liable for any failure or disruption or disconnection (including early disconnection, pre matured disconnection) of the call, call drop, call not matured, call could not be connected, unable to call the desired destination number, interrupted voice quality, completeness of the call etc. The Prepaid Customers hereby agree to indemnify and save RCII, its affiliates, directors, officers and employees harmless, from any and all losses, claims, liabilities (including legal costs on a full indemnity basis), which may arise directly or indirectly (i) from the use of a Additional Talk Time, (ii) from the breach of any of the obligations, the terms and conditions of this Agreement or any warranties and representations made to RCII, by the Customers, (iii) as a result of any claims asserted by third parties relating to the Offer. RCII reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the Customers, in which event the Customers shall cooperate with RCII, in asserting any available defenses.
10. Limitation of Liability:
    RCII shall not be liable for any special, direct, indirect, punitive, incidental or consequential damages or any damages whatsoever (including but not limited to damages for loss of profits or savings, business interruption, loss of information), whether in contract, negligence, tort, strict liability or otherwise or any other damages resulting from any of the following:
    •     the use or the inability to use the Service;
    •     any defect in the Offer/Service;
    •     any breach of the terms and conditions hereof.
11. The liability of RCII in no cases shall be more than the amount of Registration/Recharge/Payment paid by the Prepaid Customers towards the Services.
12. All incidental costs, taxes and levies related to the Offer will be borne by the Prepaid Customers.
13. In order to participate in the Offer, the Prepaid Customers must comply with such additional requirements as may be required by RCII. 
14. RCII reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify the Offer at its sole discretion as may be required by business requirements or governmental authorities and all such changes shall be binding on the Prepaid Customers without any prior communication / notice.
15. The Offer is neither assignable nor transferable under any circumstances. No substitution or refund nor exchange or redemption for an equivalent cash amount or any other benefit except what is provided as Offer Benefit shall be provided under any circumstances. The Offer once availed i.e. the Registration/Recharge is done; the same cannot be cancelled for any reason whatsoever. This Offer cannot be requested / combined with any other Offer made by RCII.
16. The claim/complaint/dispute regarding the Offer should be made within 15 days of availing the Offer. No claim/complaint/dispute will be accepted and entertained in connection with the Offer after 15 days of availing the same or the date of registration and RCII shall not be held responsible for non-acceptance of the claim/complaint/dispute. 
17. Once the Offer is availed, the amount of registration/recharge/payment is not refundable and shall not be refunded under any circumstances and the Prepaid Customers shall not initiate any chargeback for the amount of registration/recharge/payment, in case the same is done all the charges related to the chargeback will be borne exclusively by the Prepaid Customers.
18. The decision of RCII in regard to the Offer shall be final and binding and is non-contestable.
19. All disputes shall be subject to the exclusive jurisdiction of the courts in New York.
